A prenup cannot adversely affect a child’s right to support. It cannot limit remedies available to a victim of domestic violence, attempt to change the legal grounds for divorce or legal separation, or penalize someone for filing a case. Any provision that violates public policy is unenforceable. Courts will not be bound by terms that try to set parenting or custodial responsibilities in advance. These limits preserve protections for children and public safety while allowing parties to contract about property and maintenance. The unenforceable categories are spelled out in the statute.
