SBP is an optional annuity that protects continued payments after the servicemember’s death, and it can be awarded to a former spouse in a decree or agreement. If a court orders former-spouse SBP, the former spouse can file a deemed election, which must be received by DFAS within one year of the court order. Missing that one-year window can forfeit coverage, so you should calendar the deadline and submit the DD Form 2656-10 with the decree right away. Elections can be made before or after retirement depending on circumstances. Be sure the order states the correct SBP base amount and beneficiary type. DFAS and DoD explain former-spouse elections and deadlines.
