The 10-10 rule is a federal rule about how DFAS can send payments directly to a former spouse, not a rule about whether a pension can be divided. It allows direct DFAS payment only if the marriage lasted at least 10 years overlapping at least 10 years of creditable service. Even if a couple does not meet 10-10, Colorado courts can still divide military retired pay as marital property and order the servicemember to pay the former spouse. The court order must meet federal requirements to be honored by DFAS. Clarifying this distinction helps you set realistic expectations during settlement. DFAS and the USFSPA statute provide the controlling details.
