“I realize that Family Law issues can be painful, confusing, and frustrating. During a divorce or other Family Law legal matter, you may feel that you are unfairly pitted against someone you still love or once loved. These feelings can be uncomfortable, complicated, and stressful. I will actively partner with you to deescalate the conflict as I assist you in finding a successful resolution to your unique legal circumstances. When it is appropriate, we will first work together to explore solutions to your case without litigation. However, I will strongly advocate for you in court if this approach is best for you.

My practice is focused exclusively on family law issues. These include divorce, custody, post-decree modifications of parenting time, decision making, child support and spousal support, adoption, pre- and post-nuptial agreements, juvenile law, and wills and simple trusts.  I also provide unbundled legal services if you would like the help of an attorney but don’t know if full representation is right for you. Helping you to successfully manage legal costs is important, not only to me but to the entire firm.

I will always value your trust in me and will look forward to helping you to successfully resolve your pressing family law needs so that you can move forward with your new life.”

-Linda N. Kapsak, Esq.

Linda is a an experienced, thoughtful, and effective attorney.  She sees two of her greatest assets in her work with her clients as her analytical skills and her compassion. She became attracted to the possibility of working with Littman Family Law and Mediation Services due to the firm’s ongoing commitment to collaborating with each client to create their unique advocacy plan.  For families with children, Linda and the Littman Family Law team always keep the children’s best interests at the forefront of their advocacy. They work diligently to ensure that the clients’ focus always supports their children’s best interests.  She has a background in child advocacy and takes great care to consider the unique needs of children in her clients’ cases.  Finally, the firm’s long held philosophy of working to keep client legal costs reasonable while still providing topnotch legal services resonates with her.

Her legal representation is specifically tailored to each client’s needs.  She offers both full representation and unbundled legal services [see https://davidlittmanpc.com/areas/unbundled-services/].  Some situations require aggressive litigation, while others benefit from the use of alternative dispute resolution techniques such as mediation, collaborative law and creative problem-solving.  In some instances, a hybrid model of litigation and alternative dispute resolution techniques is most effective.  Colorado courts require parties to mediate before proceeding to a hearing.  Linda is an attorney who is knowledgeable and experienced in and comfortable with utilizing both litigation and ADR techniques.

Linda advocates strongly and creatively for her clients.  She sees her clients as partners in the legal process.  She believes that her clients need to be actively involved in developing their case strategies and with decision making throughout the course of representation.  She seeks to cultivate a sense of comfort, confidence and mutual respect.  It is important to her to assist each client in making wise and thoughtful financial and parenting decisions, both for the present and for the future.

Some family law matters require court involvement.  Linda is experienced and comfortable representing her clients and advocating for their interests in a courtroom setting when this approach is necessary, including obtaining protection orders.  To the extent possible, Linda does her best to help her clients avoid unnecessary litigation as it can be highly stressful, expensive and may hurt co-parenting relationships. Unfortunately, it is not always possible to avoid litigation, and when litigation becomes necessary, Linda is an experienced and knowledgeable partner for her clients in the courtroom.

Linda is trained in Collaborative Law.  This is an alternate dispute resolution approach in which both parties agree to seek the mutually best outcomes for themselves and their children.  Each party is represented by a collaboratively trained attorney with the goal of de-escalation of conflict and focus on meeting the needs of the clients and children.  Collaborative law also is an effective approach for parties who do not have children.  [see https://davidlittmanpc.com/areas/avoiding-court/collaborative-law/]  In these cases, the attorneys function as a collaborative team in assisting clients to work together during as well as after the divorce process ends.

Linda’s free time is usually spent with her fiancé, Matthew, her dog, Morrison, and her cat, Tink.  During the winter months she is an avid snowboarder.  Linda is also an accomplished baker who specializes in the creation of delicious and often ornate specialty cakes.
